A new battleground has been declared in the ongoing Cupcake Wars: The courtroom! Sprinkles Cupcakes has sued North Hollywood-based Famous Cupcakes for copying its trademarked "modern dot" design: "Unlike other cupcake imitators around the world who ceased using 'Modern Dot' after being caught by Sprinkles Famous Cupcakes has not responded to repeated requests to 'promptly stop using its trademarked design,' the lawsuit said."
According to the blog Las Vegas Trademark Attorney, Sprinkles' "nested circle" design was registered last April, with a helpful dot-placement diagram. Although we can certainly see some concentric circles in Famous Cupcakes' logo, their actual cupcakes don't seem to be topped with dots (turkeys, even, but not dots).

Keeping good on their promise, the new Crumbs Bake Shop will dole out 1,000 free cupcakes on Friday, June 6, starting at 8am. The cupcakery actually opens tomorrow (Wed 6/4), but it takes a lot of time to make 1,000 extra cupcakes, yo. Those fine Crumbs folks were supposed to open last week, canceled, but gave out free treats anyway. Oh, and it took less than two hours to go through 1,000 cupcakes then, so plan accordingly. (216 N. The Crumbs folks felt so bad about having to reneg on the promise of 1,000 free cupcakes today, so they handed out 1,000 free cupcakes today! "We thought, 'What if people don't check websites and show up anyway?' We had to do something," Crumbs West Coast partner Harley Bauter told Eater. "Our bakers worked all night. We started around 8am and by 10:47am, all the cupcakes were gone." But don't fret cupcake whores, when Crumbs officially opens (probably next week), there will be another free 1,000 treats. Let us be the first to tell you, Larchmontians: Crumbs Bake Shop opens on May 29, and with it comes 1,000 free cupcakes.
